Who is responsible for black mold removal in a Sharjah rental?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold that's been spreading along the base of the wall in our Sharjah bedroom. It started as a small patch after that really humid spell last month but now it's a long streak. Our landlord says it's our fault for not ventilating properly, but we run the AC constantly. Who is legally responsible for getting this tested and cleaned, the tenant or the landlord?

Under UAE tenancy law, the landlord is typically responsible for addressing structural issues that cause mold, like water leaks or faulty insulation. The tenant is responsible for issues stemming from daily living, like inadequate ventilation. However, the constant high humidity and AC-dependent lifestyle here creates a grey area.

Your situation—mold spreading from a wall base after a humid spell—strongly suggests an underlying moisture issue, likely from a small leak or penetrating damp, not just condensation. Running the AC constantly can actually mask the root cause if the unit isn't properly removing humidity. In Sharjah, the responsibility hinges on proving the origin. The landlord's claim it's due to poor ventilation may not hold if you can demonstrate the AC is running and the mold is originating from the building's structure.

For any visible, spreading mold, especially with health symptoms like coughing, a professional inspection is critical. They can identify the moisture source and species of mold, which is key for determining cause and necessary remediation. Document everything with photos and dates. Communicate with the landlord in writing, stating the health concerns and requesting they address the structural cause. If they refuse, you can file a complaint with the Sharjah Municipal Department. For your family's health, do not attempt to remove extensive black mold yourself, as improper cleaning can aerosolize spores and worsen the problem.
