Is landlord responsible for black mold from AC leak?« Back to Previous Page
|
The AC in my bedroom closet has been leaking for a while, and now I’ve found a huge patch of black mold spreading on the wall and our stored clothes. I’ve told my landlord about the leak a couple of times, but he just sent a handyman who did a quick fix that didn’t last. Now with the mold, is it my responsibility to clean this and replace our damaged belongings, or is the landlord legally required to handle the remediation since it's from a known maintenance issue?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for maintaining the property's structural integrity and ensuring it is habitable. This includes fixing the source of water leaks from built-in systems like the AC unit, which is considered a fundamental part of the property.
Since the AC leak is a known, recurring maintenance issue that you have previously reported, the responsibility for the resulting damage, including the black mold remediation and the repair of the AC unit itself, falls squarely on the landlord. The initial quick fix that failed did not resolve the underlying problem, which has now led to significant secondary damage. The humid Dubai climate, combined with year-round AC use, creates a perfect environment for mold to flourish rapidly from any moisture source. However, you must formally notify your landlord in writing about the mold, as this creates a legal paper trail. It is not your responsibility to perform the remediation yourself. Mold, especially the black variety, can pose serious health risks and requires professional assessment and removal to ensure it is handled safely and effectively, preventing recurrence. For a situation of this scale, we strongly recommend a professional mold inspection to assess the full extent of the growth, both visible and hidden within the wall cavity. Our certified experts at Saniservice can provide a detailed report, which can be used to formally request action from your landlord. We are equipped to handle the complete remediation process in accordance with Dubai Municipality standards. For immediate assistance, please call us at 800-66537 or email hello@saniservice.com. |
