What are my rights regarding mold?« Back to Previous Page

After the heavy rain last month, I noticed a moldy smell coming from the ceiling of my bedroom. My landlord hasn't responded to any of my emails about it, and I'm not sure if this is something I should be handling myself or if he's responsible for fixing it. Given that we've lived here for 2 years and just noticed this issue, what are my rights as a tenant regarding mold in the property?

In the UAE, particularly in Dubai, tenants have certain rights and responsibilities regarding mold. Mold can be a serious issue, especially after heavy rains like you experienced last month. It's important to address this promptly to ensure your health and comfort.

First off, your landlord is responsible for maintaining the property in good condition. This includes addressing any issues that may lead to mold growth such as leaks or dampness from rain. Given that you've lived there for two years without noticing the moldy smell until now, it’s likely not a new issue created by recent rains alone.

However, if the mold has started to appear and your landlord is not responsive, you can take several steps:

1. Document everything: Take photos or videos of the affected area, including close-ups of the mold growth. Note down when you first noticed the smell and any other observations about the condition of the property.

2. Communicate with your landlord: Try to get in touch directly by phone if email has not worked. Be polite but firm about your concerns and request that they address the issue as soon as possible.

3. Seek a professional inspection: If you're unsure about what's causing the mold or how serious it is, consider hiring an independent expert for a thorough inspection. In Dubai, companies like Saniservice offer such services and can provide detailed reports on the extent of mold damage and necessary remediation steps.

4. Know your tenant rights: According to the Real Estate Agency Law 2018 (Federal Decree-Law No. 17 of 2018), landlords must ensure that rental properties are safe, clean, and in good repair. If you find that mold is causing health issues or severely degrading the quality of your living space, you may have grounds to seek repairs or even consider moving.

5. Call for help: If you're unsure about what to do or need assistance, don't hesitate to contact Saniservice at 800-MOLDS (800-66537) or email them at hello@saniservice.com. They can offer advice on next steps and ensure that your concerns are addressed.

Remember, while mold isn’t a common issue in Dubai’s climate, it does occur, especially after heavy rains. It's important to act quickly and seek professional help if needed to prevent further damage or health issues.
