Who is responsible for fixing black mold, tenant or landlord?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold that's been spreading along the bedroom wall behind the wardrobe since the last heavy fog. We've lived in this Jumeirah Village Triangle apartment for 2 years and just noticed it when we moved the furniture. Who is responsible for fixing this and the cost, me as the tenant or my landlord?

The responsibility for fixing black mold in a rental property in Dubai is typically determined by the cause. Since you've noted it appeared after heavy fog and is on an exterior wall behind furniture, this strongly suggests a building envelope or pre-existing moisture issue, which is the landlord's responsibility to rectify. The landlord is obligated to provide a habitable property under Dubai's rental laws.

Your immediate step should be to formally notify your landlord or property management company in writing, including clear photos of the mold and its location. Do not attempt to remove it yourself, as improper handling can release more spores. For a case involving persistent coughing, especially in children, a professional indoor environmental assessment is strongly recommended to identify the mold species and the exact moisture source. This documented report is crucial evidence for your landlord and can guide the proper remediation process.

In Dubai's climate, high humidity and condensation from year-round AC use can create ideal conditions for mold, especially in poorly ventilated areas or where thermal bridging occurs in building walls. The landlord should arrange for a qualified contractor to address the leak or condensation source and perform the remediation. As the tenant, your responsibility is to maintain good ventilation, report issues promptly, and allow access for repairs. The cost of fixing the underlying structural cause and the remediation itself should be borne by the landlord.
