Who is responsible for mold remediation, tenant or landlord?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold growing along the bottom of the bedroom wall in our Jumeirah apartment. It started appearing about two months ago after our AC unit started leaking a bit. I'm not sure if I should be buying a dehumidifier myself or if this is something the landlord is legally required to fix and pay for. Who is responsible for the mold remediation in a rental, the tenant or the landlord?

Based on UAE rental law, specifically Law No. (26) of 2007, the landlord is generally responsible for maintaining the structural integrity of the property and its major systems, including the air conditioning unit. Since the mold in your Jumeirah apartment originated from an AC leak, the responsibility for the underlying cause and its remediation almost certainly falls on your landlord.
The persistent humidity and year-round AC usage in Dubai create a perfect environment for mold, especially when a malfunctioning unit introduces excess moisture. The black mold you describe is a serious health concern, particularly for children, and the coughing you've observed is a common symptom of mold exposure. Your first step should be to formally notify your landlord or property management company in writing about the issue, including the AC leak and the resulting mold growth. They are obligated to address the root cause (repairing the AC) and should arrange for professional mold remediation. Do not attempt to remove significant mold growth yourself, as improper handling can disturb spores and worsen air quality. For a situation involving health symptoms and visible black mold, we strongly recommend a professional inspection. Our certified experts at Saniservice can conduct a thorough assessment to identify the exact mold species, the extent of the contamination, and provide a detailed report that can be used to ensure your landlord completes the repairs and remediation correctly.
